Democrat Tom Malinowski, who has represented the district since 2019, was re-elected with 50.6% of the vote in 2020.[1] Malinowski was unseated by Republican Thomas Kean, and afterward said he wouldn’t run for the seat in 2024. [56]
The boundaries of the district had been redrawn from 2020 determined by the 2020 redistricting cycle. The district was drawn to be more Republican-leaning in order for surrounding districts to become more Democratic-leaning. This protected two other vulnerable Democratic-incumbents at the cost of Malinowski facing an even tougher reelection bid in 2022.

General election
Veronica Fernandez was running for this seat as an independent, but later dropped out, citing no path to victory.[63]
On June 7, it was announced that the newly formed Moderate Party would seek to nominate Malinowski as their candidate via electoral fusion, although fusion voting is currently banned in New Jersey.[64] The next day, the Secretary of State Tahesha Way blocked the nomination, but the Moderate Party filed a lawsuit to challenge this, however, a ruling isn't expected until summer of 2023 preventing them from being on the ballot.[65][66]
