The Health Protection (Coronavirus, Wearing of Face Coverings on Public Transport) (England) Regulations 2020 (SI 2020/592) is a statutory instrument (SI) brought into force on 15 June 2020 by the Secretary of State for Transport, Grant Shapps, in response to the COVID-19 pandemic. The regulations required the wearing of a face covering when travelling on public transport such as trains, buses and aircraft in England, later extended to include taxis and private hire vehicles. The regulations were revoked on 18 July 2021.
Initial regulations
Legal basis
The regulations were introduced by way of a statutory instrument made by the Secretary of State for Transport, Grant Shapps, using emergency powers available to him under the Public Health (Control of Disease) Act 1984. The regulations themselves stated the legal basis for using such powers, namely "the serious and imminent threat to public health which is posed by the incidence and spread of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) in England"; he also certified that the restrictions "are proportionate to what they seek to achieve, which is a public health response to that threat."Шаблон:Sfnp
The regulations were made on 14 June, and were laid before parliament and simultaneously came into force the next day.Шаблон:Sfnp The Secretary of State used section 45R of the Public Health (Control of Disease) Act 1984 to enact the regulations without prior parliamentary consideration, subject to retrospective approval by resolution of each House of Parliament within twenty-eight days.Шаблон:Sfnp
Geographical scope
The regulations covered England onlyШаблон:Sfnp (the rules in Scotland, Wales and Northern Ireland differed). They also extended to any aircraft while in English airspace that took off from or was to land in England,Шаблон:Sfnp as well as any vessel in UK territorial waters adjacent to England, apart from vessels just passing through.Шаблон:Sfnp
Requirement to wear a face covering when on public transport
Subject to a number of exceptions, nobody was allowed – unless they had a "reasonable excuse" – to use public transport without wearing a face covering.Шаблон:Sfnp For this purpose, "public transport" did not include school transport, a taxi or private hire vehicle, nor a cruise ship.Шаблон:Sfnp
Any type of face covering was considered acceptable, provided that it covered the wearer's nose and mouth;Шаблон:Sfnp the regulations did not require or mention a 'mask'. The covering had to be worn both while boarding and while actually on board any public transport vehicle.Шаблон:Sfnp
Several groups of people were exempt from the requirement to wear a face covering, including children under the age of 11,Шаблон:Sfnp public transport staff,Шаблон:Sfnp police officers,Шаблон:Sfnp and emergency responders while on duty,Шаблон:Sfnp as well as travellers who had their own private cabin or berth.Шаблон:Sfnp Face coverings were not required where travellers were transported and remained in a separate vehicle,Шаблон:Sfnp for example a car ferry.
Reasonable excuse
The regulations provided a list of excuses for not wearing a covering which were considered to be "reasonable", while not excluding other possibilities: where the traveller was unable to wear a covering due to a disability, or where it would cause severe distress;Шаблон:Sfnp to facilitate lip reading;Шаблон:Sfnp where the covering was removed to avoid the risk of harm;Шаблон:Sfnp where a person travelling to escape a risk of harm had no covering with them;Шаблон:Sfnp where reasonably necessary to eat, drink or take medication;Шаблон:Sfnp or where instructed to do so by an official.Шаблон:Sfnp
Offences and enforcement
It was a criminal offence to contravene the regulations,Шаблон:Sfnp and offenders could be prosecuted.Шаблон:Sfnp Both police officers and public transport staff had the power to deny boarding to anyone not wearing a covering;Шаблон:Sfnp and a traveller already on a vehicle could be directed to wear a covering or to disembark.Шаблон:Sfnp Police and Transport for London officials (but not public transport staff) also had the power to remove from a vehicle anyone not complying with a direction,Шаблон:Sfnp using force if necessary,Шаблон:Sfnp and to issue a fixed penalty notice of £100 (reduced to £50 if paid within 14 days).Шаблон:Sfnp
Review and expiry
The Secretary of State was required to review the regulations by 15 December 2020.Шаблон:Sfnp The original expiry date was stated to be 15 June 2021,Шаблон:Sfnp later replaced by 21 June 2021,Шаблон:Sfnp then by 18 July 2021.Шаблон:Sfnp
